Remote lighting-design and production-assessment services
Version 1.0 | 4 September 2026
1. Provider and scope
These Terms and Conditions apply to services supplied by Heinz Marc Schneider, trading as Get Your Lightshow, a self-employed professional (autónomo) established in Spain.
Business address: Lugar San Ambrosio, 9998, 11159 El Palmar (Vejer de la Frontera), Cádiz, Spain. Email: info@getyourlightshow.com. Telephone: +34 634 418 735. Tax identification number: Y0157895Z.
These Terms apply to remote lighting-design, production-assessment and related professional services unless the parties expressly agree otherwise in writing.
2. Definitions
"Client" means the person or organisation identified as the contracting party in the applicable proposal.
"Business Client" means a Client acting for purposes relating to its trade, business, craft or profession, or otherwise acting as an entrepreneur or professional under applicable law.
"Consumer" means a Client who qualifies as a consumer under mandatory applicable law.
"Project" means the specific production or scope identified in the accepted proposal.
"Services" means the professional services described in the accepted proposal and these Terms.
"Deliverables" means the final documents, visualisations, plans, scripts, reports or other materials expressly identified for delivery in the accepted proposal.
"Written" or "in writing" includes email and other text-based communication channels expressly agreed for the Project. Telephone calls and voice messages do not constitute binding project instructions unless their content is subsequently confirmed in writing.
3. Service model and place of performance
Get Your Lightshow is established in Spain. Unless expressly agreed otherwise, the Services are created and performed remotely from Spain.
No on-site attendance, physical rigging, focusing, electrical installation, show operation, touring technician service or other venue-based work is included unless expressly stated in the proposal.
The fact that Deliverables are supplied electronically does not change the individually created and professionally performed nature of the Services.
Mandatory tax rules determining the statutory place of supply remain unaffected by this contractual description.
4. Free Initial Project Review
Submitting the Free Initial Project Review, questionnaire, project materials or any other enquiry does not create a booking, contract or payment obligation.
The Project Review is used to assess suitability, scope, complexity, available information and the appropriate service. Get Your Lightshow may recommend a service, request additional information, decline a project or state that the project is not currently available for acceptance.
5. Website service fees and proposals
Amounts displayed on the website are service fees unless expressly stated otherwise. They do not constitute an automatically bookable worldwide tax-inclusive price.
Applicable VAT or other tax treatment depends on the Client's status, location and the tax rules applicable to the transaction.
Before a Client becomes contractually bound, the individual written proposal will state the applicable service fee, tax treatment and complete amount payable.
Production Lighting Design is individually priced according to the Project scope. Defined-scope services may be declined or replaced by a recommendation for a broader service where the submitted Project does not fit the stated scope.
6. Proposal validity and formation of the contract
Unless a proposal states a different period, it remains available for acceptance for 7 business days. For these Terms, a business day means Monday to Friday excluding public holidays applicable at the Provider's place of business in Spain.
The Client may confirm in writing that it wishes to proceed with the proposal. That written confirmation alone does not reserve capacity and does not create a binding contract.
A binding contract is formed when the required initial payment specified in the proposal is received by Get Your Lightshow within the validity period of the proposal. Before receipt of the required initial payment, the Project is not accepted or booked.
If payment is not received within the proposal validity period, Get Your Lightshow may withdraw or revise the proposal, price, schedule or availability.
Where mandatory consumer law requires additional pre-contractual information, acknowledgement or a different formation step, the mandatory requirement takes precedence.
7. Payment terms
7.1 Lighting Design for Dance, Lighting Design for Scenic Theatre and Production Lighting Assessment
These services require 100% payment of the amount stated in the proposal before work begins.
7.2 Production Lighting Design
Production Lighting Design normally requires 50% of the total amount stated in the proposal before work begins and the remaining 50% before release of the final Deliverables.
Drafts, review material or selected previews may be provided before the final payment where required by the agreed review process. Final Deliverables may be withheld until all due amounts have been received.
7.3 Payment method and charges
The accepted payment method and any payment instructions are stated in the proposal or invoice. The Client is responsible for bank or transfer charges imposed on the Client's side unless otherwise agreed.
No additional payment-method charge will be imposed on a Consumer where prohibited by applicable law.
8. Start of work and project schedule
Work begins only after all of the following have occurred:
- a binding contract has been formed in accordance with Section 6;
- the required initial payment has been received;
- the information and project materials reasonably required to begin the agreed work have been received; and
- where relevant, any legally required request for early commencement during a consumer withdrawal period has been obtained.
Any stated delivery date or project schedule is based on the information, approvals and cooperation expected at the time the schedule is agreed.
If required information, approvals or feedback are supplied late, the delivery schedule may be reasonably extended. Get Your Lightshow is not responsible for delay caused by Client-side delay, incomplete information or material changes to the Project.
9. Client cooperation and accuracy of information
The Client must provide information that is reasonably complete, accurate and current. Depending on the Project, this may include scripts, running orders, stage plans, scenic information, venue data, rigging information, technical riders, equipment lists, rehearsal material, artistic direction and information concerning relevant decision-makers.
The Client must notify Get Your Lightshow promptly of material changes to the production.
Get Your Lightshow may rely on information supplied by the Client unless an obvious inconsistency is identified. Additional work caused by inaccurate, incomplete, late or materially changed information may require a revised schedule and additional fees. Additional paid work will not be undertaken without prior written agreement.
10. Client authority and third-party materials
The person placing the Project on behalf of an organisation represents that they are authorised to provide the relevant information and to act for that organisation in relation to the Project.
The Client is responsible for ensuring that scripts, plans, photographs, videos, music-related material, technical documentation and other materials supplied for the Project may lawfully be provided and used for the agreed purpose.
Ownership of Client-supplied material remains with the Client or the relevant third-party rights holder. No ownership is transferred to Get Your Lightshow.
11. Written project communication and decision-making
Project instructions, approvals, revision requests, scope changes and final design approvals must be communicated in writing.
Where several people are involved in a production, the Client must identify the person or persons authorised to give binding creative or production approvals. Get Your Lightshow is not responsible for internal disagreements within the Client's production team.
For Production Lighting Design, Get Your Lightshow may require written communication with the person who has final artistic authority for the lighting design before accepting or continuing the Project.
12. Defined-scope services
12.1 Lighting Design for Dance
The current standard defined-scope Dance service includes the scope stated in the proposal and service description, normally including up to 8 principal lighting moods, an adaptable lighting concept or lightplot, visual guidance, technical implementation notes and one structured revision.
Console programming and a showfile are not included unless expressly stated otherwise.
12.2 Lighting Design for Scenic Theatre
The current standard defined-scope Scenic Theatre service includes the scope stated in the proposal and service description, normally including up to 6 principal scenic lighting states, smaller specials, blackouts, effects and transitions within those states, a Visual Scene Guide, Adaptive Lightplot, Annotated Lighting Script, technical implementation notes and one structured revision.
The number of principal lighting states does not equal the number of script scenes. Several scenes may use the same principal lighting state.
13. Production Lighting Assessment
The Production Lighting Assessment is a professional analytical service and not a completed lighting design.
It may address production evaluation, dramaturgical lighting potential, technical feasibility, touring suitability, risks and dependencies, priorities, next steps, assumptions and limitations, together with other items stated in the proposal.
The Assessment does not include a design-revision round. Get Your Lightshow will, however, correct material factual errors in the Assessment where the information originally supplied by the Client was accurate and the error is attributable to Get Your Lightshow.
14. Production Lighting Design
Production Lighting Design is individually scoped and may combine artistic lighting design with production documentation intended to support practical implementation, touring and venue adaptation.
Deliverables may include a Lighting Design Dossier, visualisations, Visual Scene Guide, Adaptive Lightplot, Annotated Lighting Script, dramaturgical description, scene overview, technical notes, venue or touring notes and setup recommendations, as specified in the proposal.
Unless otherwise stated, Production Lighting Design includes up to two structured review rounds before final Design Approval.
15. Revisions and scope changes
A revision means a structured change within the agreed Project scope and established creative direction.
Feedback must identify the requested change with sufficient clarity for the design issue to be understood. General instructions such as a request to make the design 'different' without identifying the desired change may be returned for clarification.
A fundamental change to the script, running order, scenic concept, artistic direction, venue assumptions, production scale or other material Project foundation is not a revision. Such changes may require a separate quotation or revised proposal.
16. Design Approval and Design Freeze
Where a Project includes formal Design Approval, the creative design is developed and reviewed before extensive final technical documentation is completed.
After the Client gives final Design Approval, the general creative and dramaturgical direction is considered frozen. Fundamental creative changes requested after that point are outside the agreed scope unless separately agreed in writing.
17. Assessment credit
Where a Production Lighting Assessment is followed by a Production Lighting Design for the same production, the €449 Assessment service fee will be credited in full against the Production Lighting Design service fee, provided that the script, scenic concept and material Project scope have not fundamentally changed.
If those Project foundations have materially changed, Get Your Lightshow will advise the Client before the Production Lighting Design contract is formed whether further assessment work is required and whether any credit can still be applied.
18. Cancellation by the Client
18.1 Consumers
Consumers retain all mandatory statutory withdrawal and cancellation rights. Nothing in this Section limits those rights. The separate Withdrawal Information explains the statutory distance-contract withdrawal right and the consequences of requesting that work begin during the withdrawal period.
18.2 Business Clients before work begins
A Business Client may request cancellation before work has begun. If Get Your Lightshow accepts the cancellation before commencement, amounts received for unperformed work will be refunded, less any non-recoverable third-party cost expressly authorised by the Business Client.
18.3 Business Clients after work begins
Once work has begun, a Business Client has no contractual right to cancel the Project unilaterally for convenience unless the proposal expressly provides otherwise.
Any cancellation accepted by Get Your Lightshow after commencement is without prejudice to amounts already earned, work performed, agreed project commitments and any other rights arising under the contract or applicable law.
19. Suspension or termination by Get Your Lightshow
Get Your Lightshow may suspend performance where a due payment has not been received, required Project information is materially incomplete, the Client fails to provide required approvals, or continuing the work would reasonably create legal, safety or rights-infringement concerns.
If a material Client breach is not remedied within a reasonable written period after notice, Get Your Lightshow may terminate the affected Project. Amounts due for work already performed remain payable, subject to mandatory consumer rights.
If Get Your Lightshow is unable to perform a Project for reasons attributable to Get Your Lightshow and terminates the Project, prepaid amounts relating to unperformed Services will be refunded.
20. Delivery and file formats
Deliverables are supplied in the formats stated in the proposal. Client deliverables may include high-resolution PDF documents and other agreed files.
Public website demonstrations may be displayed in reduced resolution and are not representative of the resolution of final Client deliverables.
Unless expressly included, editable source files, 3D project files, console showfiles, proprietary working files and internal production files are not Deliverables.
21. Intellectual property and production licence
Copyright and other intellectual-property rights in original Deliverables created by Get Your Lightshow remain with their author unless a specific written transfer states otherwise.
After full payment of all amounts due for the Project, the Client receives a non-exclusive, worldwide licence for the full legal term of the relevant copyright to use the final Deliverables for the specific production identified in the Project agreement.
The licence expressly permits:
- rehearsals and performances of the identified production;
- touring and guest performances in any country;
- use at an unlimited number of venues for that production;
- later revivals or re-stagings of the same production;
- reasonable venue-specific technical adaptation necessary to implement the design;
- reproduction and sharing of the Deliverables with venues, lighting programmers, technicians, production staff and service providers involved in implementing that production.
The licence does not permit:
- use of the Deliverables as the lighting design for an unrelated production;
- resale, sublicensing or commercial distribution of the Deliverables as templates, stock material or standalone design products;
- publication of the Deliverables as the Client's own original design work;
- removal of authorship or copyright information where such information is included and its removal is not reasonably necessary for technical production use.
The licence does not transfer ownership of copyright. Any broader assignment or licence must be expressly agreed in writing.
22. Portfolio and publicity
Get Your Lightshow will not publish identifiable Client project material, production documents or Deliverables as portfolio or promotional material without the Client's separate permission.
A separate portfolio permission may define the material, production name, timing and permitted channels of publication. Refusal of portfolio permission does not affect the Services.
23. Confidential project material
Non-public scripts, production documents, rehearsal material and other confidential Project information will be used only as reasonably necessary to review, perform or administer the Project, subject to applicable legal obligations.
This confidentiality commitment does not apply to information that is already lawfully public, was lawfully known independently, is received lawfully from another source without confidentiality restrictions, or must be disclosed by law or competent authority.
24. Functional and venue-adaptable design
Lighting designs may intentionally be function-based rather than tied to a fixed fixture model, exact hanging point or single venue.
The objective may be to define what the light must achieve artistically and technically while allowing appropriately qualified local personnel to adapt the implementation to the equipment and physical conditions of a particular venue.
Substitution of fixtures or changes to venue implementation must preserve the design function as far as reasonably possible and should be assessed by competent technical personnel.
25. Technical implementation and safety
The Client, venue and persons carrying out the physical implementation remain responsible for venue-specific technical and safety compliance, including structural capacity, rigging, electrical safety, working at height, fire safety, haze or smoke restrictions, local licensing requirements and equipment suitability.
Unless expressly agreed and lawfully provided by a suitably qualified professional, Get Your Lightshow documentation is not a structural engineering certificate, rigging certification, electrical inspection, fire-safety approval or venue safety certificate.
A design document does not authorise a person to perform work for which local law, venue rules or professional standards require specific qualifications.
26. Visualisations and expected real-world result
3D renders, visualisations and similar images communicate the intended design concept. They are not a guarantee of a pixel-identical or photometrically identical real-world result.
Actual appearance may vary because of fixture output and optics, calibration, venue dimensions, hanging positions, scenic materials, costume colours, ambient light, haze levels, programming, local focusing and other production conditions.
27. Responsibility for local programming and implementation
Unless expressly included, Get Your Lightshow does not provide the console programming, patch, cue entry, showfile, focus session or live operation required to implement the design.
Local programmers and technicians remain responsible for translating the design documentation into the available control system and venue equipment, while respecting the intended design functions.
28. Liability
28.1 Mandatory rights
Nothing in these Terms excludes or limits liability or statutory rights where such exclusion or limitation is prohibited by applicable law. Mandatory Consumer rights remain unaffected.
28.2 Business Clients
For Business Clients, and to the extent permitted by law, Get Your Lightshow is liable for foreseeable direct loss caused by a proven contractual breach.
To the extent permitted by law, the aggregate liability of Get Your Lightshow arising from ordinary negligence in connection with a particular Project is limited to the total service fees paid or payable for that Project.
This limitation does not apply to fraud or wilful misconduct, death or personal injury caused by liability that cannot lawfully be excluded, or any other liability that applicable law does not permit to be limited.
Get Your Lightshow is not responsible for loss caused by inaccurate Client information, unauthorised changes, implementation contrary to the Deliverables, unsafe or defective local equipment, or work performed by third parties outside Get Your Lightshow's control.
29. Force majeure and events outside reasonable control
Neither party is liable for delay or failure caused by events outside its reasonable control, provided that the affected party takes reasonable steps to mitigate the effect and communicates material delay where practicable.
Where such an event materially affects the Project schedule, the parties will seek a reasonable revised schedule. Mandatory Consumer rights remain unaffected.
30. Project file retention after completion
Operational Project files are normally retained for up to one year after Project completion and may then be deleted.
The Client is responsible for securely archiving final Deliverables after delivery. Get Your Lightshow has no obligation to maintain editable working files or replacement copies indefinitely.
Legally required accounting, tax, contract and business records may be retained for longer statutory periods in accordance with the Privacy Policy.
31. Complaints and consumer ADR information
Complaints must be submitted in writing to info@getyourlightshow.com or the postal correspondence address stated in the Legal Notice.
If a complaint made by a Consumer cannot be resolved directly, Get Your Lightshow will provide the information required by applicable consumer ADR law, including information about at least one competent accredited alternative dispute-resolution entity where legally required and whether Get Your Lightshow will participate in that procedure.
Get Your Lightshow does not state that it is voluntarily bound to participate in a specific ADR scheme unless this is expressly communicated.
The former European Union Online Dispute Resolution platform is no longer available and is not referenced as a dispute-resolution channel.
32. Governing law
The contract is governed by Spanish law.
For Consumers, this choice of law does not deprive the Consumer of mandatory protections that cannot lawfully be excluded under the rules applicable to the Consumer contract.
33. Courts and jurisdiction
Mandatory rules on territorial and international jurisdiction remain unaffected.
These general Terms do not purport to create an express submission to a particular Spanish court where such a submission would be invalid because the clause forms part of general or adhesion terms.
For Business Clients, Cádiz, Spain may be agreed as the intended forum in an individually negotiated written Project agreement where such an agreement is legally valid. In the absence of a valid individual jurisdiction agreement, the competent courts are determined by applicable procedural law.
Consumers retain any jurisdiction rights granted by mandatory applicable law.
34. Contract language
A Project may be contracted in English, German or Spanish, as stated in the applicable proposal.
Where mandatory Consumer law requires pre-contractual information to be supplied in Spanish or another legally required language, that information will be provided before the Consumer becomes contractually bound.
Project communication remains written unless a particular non-binding discussion is expressly agreed otherwise.
35. Order of precedence
If a written Project proposal expressly conflicts with these Terms, the Project proposal prevails for the specific matter addressed, except where mandatory law provides otherwise.
Client purchase-order terms or other Client standard terms do not replace these Terms unless Get Your Lightshow expressly accepts the relevant terms in writing.
36. Severability and no waiver
If a provision is found invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law. The parties will, where appropriate, replace the affected provision with a lawful provision that most closely reflects its commercial purpose.
Failure to enforce a contractual right on one occasion does not constitute a waiver of that right on another occasion.
37. Changes to these Terms
The version of these Terms supplied or made available before formation of a particular contract applies to that Project. Later website changes do not retrospectively alter an existing contract unless the parties agree otherwise in writing.
